2/ 23.03.2011 Heard learned counsel for the parties.

This is a case of misuse of privilege of bail in a case

under Sections 419, 420, 489(b) and 489(c) of the Indian Penal

Code.

Learned counsel for the petitioner submits that for

misuse of privilege of bail of two years, the petitioner has already

remained in custody for three months. He further submits that

petitioner would cooperate in trial.

In the circumstances, petitioner, named above, is

directed to be released on bail on furnishing bail bond of Rs.

5,000/- (Five thousand) with two sureties of the like amount each

to the satisfaction of Additional Sessions Judge, Fast Track Court

No.-V, East Champaran at Motihari in connection with S. Tr. no.

338 of 2004, with the condition that the petitioner will cooperate

in the trial.
