W.P.(C)NO.11046 of 2007
-----------------------------------------
Dated this the 29th day of March, 2007
JUDGMENT
The petitioner is working as Nursing Superintendent
Grade I in the Medical College Hospital, Alappuzha. She had filed
an application on 22.2.2007 requesting to consider her case for
transfer and posting to District Hospital, Kottayam at the time of
general transfers of 2007. Pending that application, the petitioner
could learn that certain vacancies that arose in the cadre of
Nursing Superintendent Grade I were filled up by the
Government, but the petitioner’s case was not considered. In the
above circumstances, the petitioner feels aggrieved by the above
action of the Government. It is contended that some more
vacancies have arisen and there are three vacancies at Kottayam
including one vacancy in the District Hospital, Kottayam and
another in the Institute of Child Health, Medical college,
Kottayam and yet another at Medical College Hospital, Kottayam.
The petitioner is desirous of getting a transfer to any one of these

vacancies.
2. Ext.P7 representation was filed in the above background.
Counsel for the petitioner submits that this Court may direct the
Government to consider Ext.P7 and dispose of the same as early
as possible. The petitioner is due to retire from service within one
year.
3. In case, the above three vacancies are likely to be filled
up before general transfers and postings would take place, it is
only proper that the petitioner’s case is considered against any
one of the vacancies mentioned above. Ordered accordingly.
The first respondent shall pass orders on Ext.P7 within three
weeks from the date of receipt of a copy of the judgment.
