The petitioner is a licenced Government contractor. He
claims to have undertaken and satisfactorily completed various
works for the respondent. According to the petitioner, bills were
sanctioned to be paid to him for the works done by him.
However, in view of a suit filed by one Mr.Rajan against the
petitioner, the amount is not being paid in view of the prohibitory
order in that suit. The petitioner now submits that that suit has
been dismissed and appeal has also ended in favour of the
petitioner. Therefore, the petitioner seeks a direction to the
respondent to consider and pass orders on Ext.P4 expeditiously.
2. I have heard the learned Government Pleader also.
3. In the facts and circumstances of the case, there
would be a direction to the respondent to consider and pass
orders on Ext.P4 representation, as expeditiously as possible, at
any rate, within one month from the date of receipt of a copy of
this judgment. Before releasing payment to the petitioner, if due,
w.p.c.6250/08 2
the respondent shall make sure that the interim order in the suit
and further proceedings are not in force at present.
The writ petition is disposed of as above.
