Rule.

Ms.Mita Panchal, learned APP waives service of rule for the State.

The
applicant had filed appeal through the jail authorities and along
with that he has submitted this application for condonation of delay
of 439 days caused in filing the appeal for which he has submitted
the reasons in the application. The said matter was handed over to
Mr.M.R.Prajapati, learned advocate by the Legal Department. He has
submitted that as the applicant was not in a position to contact
advocate or move an application as he was undergoing sentence, the
delay is caused.

Considering
the averments made in the application, the delay caused in filing the
appeal is condoned. This application is allowed. Rule is made
absolute accordingly.

Office
is directed to place the main appeal for admission on 30.8.2006.
