Mr.Kirtidev Dave, learned counsel for the appellant and Mr.Kanubhai
Patel, learned counsel for respondent
Nos.2 to 5.
Mr.Patel,
learned counsel for respondent
Nos.2 to 5, has contended that the matter is resolved between the
parties outside the Court and on behalf of respondent
Nos.2 to 5, a cheque bearing No.906960 of Rs.30,000/- (Rupees Thirty
Thousand Only) dated 16th August, 2011 drawn on State
Bank of India, Vijaynagar Branch is handed over to the appellant.
Mr.Patel has further contended that the parties have amicably
settled their disputes and Terms of Compromise is arrived at between
the parties and therefore, prayed to dispose of the present appeal
in view of compromise arrived at between the parties.
Heard
Mr.Dave, learned counsel for the appellant. He has submitted that a
cheque amounting to Rs.30,000/- is received by him on behalf of the
appellant. He has also contended that the parties have amicably
settled the dispute outside the Court. He, therefore, contended that
in view of compromise arrived between the parties, he may be
permitted to withdraw the present appeal.
Heard
learned counsel for the respective parties. The Terms of Compromise
dated 30th August, 2011 arrived at between the parties is
taken on record. As per the Terms of Compromise, learned counsel for
respondent Nos.2
to 5 has handed over a cheque amounting to Rs.30,000/- to the
learned counsel for the appellant as full and final settlement.
In
view of above, present appeal stands disposed of as withdrawn.
