ORDER

The
present petition has been filed by the petitioners under Articles
14, 21, 226 and 227 of the Constitution
of India for the prayer that the respondent
authorities may be directed to accept the payment of the amount for
the land in question admeasuring 260.47 Sq.Mtrs. situated in City
Survey No.1202/A of Patan as per the Resolutions dated 09.10.1998
and 17.11.2000 and also further direction to the Collector, Patan to
issue letter regularizing the land in question in favour of the
petitioners for the reasons mentioned in the petition.

After
arguing for some time, learned counsel, Mr.Joshi for the petitioners
seeks permission to withdraw this petition with a view to make
representation before the respondent no.2, which shall be considered
sympathetically.

As
it transpires from the record that the decision for the allotment of
the land was also taken by the authority and in fact, the Price
Committee had also revised the price and reduced it. However, the
amount could not be paid as stipulated, which has led to filing of
the present petition. Therefore, interest of justice would be served
if necessary directions may be issued.

In
the circumstances, the petitioners shall make representation to the
respondent no.2-Collector within a period of 15 days specifically
stating about the depositing the amount, which was not deposited in
time and condoning the same, which shall be considered
sympathetically by the respondent no.2-Collector within a period of
one month thereafter.

With
these observations and directions, the present petition stands
disposed of accordingly.
