ORAL
ORDER

Present
applications are taken out by the applicants seeking below mentioned
relief:

5(B)
Your Lordship may be pleased to permit the applicant herein to
withdraw 80% of the amount deposited by the opponents herein with the
trial Court pursuant to the order dated 05.05.2008 passed in Civil
Applications No.5428 to 5437 of 2008.

Heard
learned advocate Mr. Patel appearing for the applicants and learned
AGP appearing for the respondent State in each application.

The
cause list shows that the main First Appeals and the Civil
Applications for stay in connection with which present Misc. Civil
Applications have been preferred (seeking disbursement of amount)
have been finally heard and disposed of on 13/2/2009 and 5/5/2008
respectively.

Learned
advocate Mr. Patel appearing for the applicants has confirmed the
said factual aspect mentioned in the cause title.

Since
the main the First Appeals and the Civil Applications for stay are
disposed of, present applications do not survive and they have
rendered infructuous. The Misc. Civil Applications are disposed of
accordingly as having become infructuous upon disposal of parent
appeals and civil applications for stay.

J.)
