                             JUDGMENT

The writ petitioner is presently working as Assistant

Director of Agriculture at Nedumkandam in Idukki District. He

has approached this Court challenging Ext.P1 order by which he

was transferred to Thalassery in Kannur District in an existing

vacancy. This year he had requested for a suitable posting in

Kottayam District. The third respondent who has been

promoted as Assistant Director of Agriculture stands posted in

his place in Nedumkandam. Even though on 5.03.2009, while

admitting the writ petition an order of status-quo was passed by

this Court, subsequently, when the matter came up for hearing

on 6.03.2009, the learned counsel appearing for the petitioner

submitted that the third respondent has assumed charge on

5.03.2009 FN. Notice was ordered by Special Messenger to her

on 06.03.2009 and the case was ordered to be posted today for

hearing.

2. The third respondent appeared in person today before

this Court. It is submitted by her orally that she being a

promotee she is willing to be posted as Assistant Director in

wpc:7211 of 2009

Thalasserry instead of the petitioner being transferred to

Thalasserry. The above submission is recorded. Appropriate

orders will be passed by the second respondent within a period

of ten days from the date of receipt of a copy of this judgment.

The third respondent will give in writing her consent before the

second respondent in tune with the submission made before this

Court also. The writ petitioner will produce a copy of the

judgment for compliance.

The writ petition is disposed of as above.
