Heard learned counsel for the applicants, learned AGA for the State and
perused the record.
Learned counsel for the applicants submitted that due to some
misunderstanding, first information report was lodged. He further submitted
that if the matter will be referred to Mediation and Conciliation Centre then
there is chances of compromise in between the parties.
Issue notice to opposite party no. 2 returnable at an early date. If a draft for a
sum of Rs. 10,000/- (ten thousand) is deposited with the Registry of the High
Court in favour of opposite party no.2, Smt. Tarannum Parveen within a
period of three weeks, the matter will be referred to Mediation Centre. The
aforesaid draft, which is in the name of opposite party no.2 shall be handed
over to her on her first appearance. If she fails to appear the aforesaid draft
shall be returned to applicant within period of validity.
List on 10.8.2010 before the appropriate Court with report of the Mediation
Centre, if any.
Till the next date of listing, further proceedings of Case No.2212 of 2010,
Case Crime No.4/2010, State Vs. Vaseem and others, under Sections 498-A,
323, 324, 307, 504, 506 IPC and Section 3/4 Dowry Prohibition Act, P.S.
Syohara, District Bijnor shall remain stayed.
If the amount is not deposited within aforesaid period the aforesaid interim
order shall automatically stand vacated.
