ORDER
The
submission of the Registry dated 16.03.2011 as well as the
endorsement on the Board indicate that the notice issued to the
petitioner No.1 for engaging another advocate in place of the then
learned advocate appearing for him has remained unserved as
petitioner No.1 has expired. Further, petitioner No.4 has remained
unserved as he is stated to have retired, as per the report of the
Bailiff. It is stated by Mr.Mahesh Bhavsar, learned advocate, that he
has no instructions as regards petitioners Nos.1 and 4 and he is only
appearing for petitioners Nos.2 and 3.
As
the petitioner No.1 has expired and his heirs have not been brought
on record, the petition qua petitioner No.1 stands abated.
At
the request of Mr.Mahesh Bhavsar, learned advocate for petitioners
Nos.2 and 3, list on 20.04.2011, in order to enable him to take
instructions.
