Heard learned counsel for the applicant, learned A.G.A.
and perused the record.
Learned counsel for the applicant submitted that there
was no allegation against the applicant he was falsely
implicated in the present case. However, subsequently
in the statement of the prosecutrix the allegation was
made against him. She was major according to the
medical report. Even if the prosecution story is
admitted, it appears that she was a consenting party.
However, the applicant is in jail since 5.6.2010.
Learned A.G.A. opposed aforesaid prayer of bail.
In view of the above, without expressing any opinion on
merit, it is a fit case for bail.
Let the applicant Veeresh be enlarged on bail on his
furnishing a personal bond with two sureties each in the
like amount to the satisfaction of the court concerned in
Case Crime No.147/10 under Sections 363, 366, I.P.C.
and PS. Iradat Nagar, District Agra.
