Heard learned counsel for the petitioner

sand learned Additional Public Prosecutor for the

State.

The three petitioners are named accused

in this case.

Learned counsel seeks permission to

withdraw the application on behalf of petitioner

no.3, Sofi Mandal, with liberty that prayer may be

considered on its own merit without being

prejudiced of withdrawal of this application.

Application on his behalf is permitted to be

withdrawn with the above liberty.

Submission is that no allegation is

against the two petitioners no.1 and 2 Vijay

Kumar Mandal @ Vijay Kumar Marmar and

Mukeshd Mandal.

Considering the facts and circumstances,

the petitioner no.1 and 2, in the event of arrest or

surrender within four weeks from today, are

directed to be enlarged on bail on each of them

furnishing bonds of Rs. !0,000/- (Rupees ten

thousand) with two sureties of the like amount

each to the satisfaction of Chief Judicial

Magistrate, Katihar, in Barari P.S. Case no. 66 of

2011, subject to the conditions laid down in

Section 438 (2) of the Code of Criminal Procedure

with additional condition that the petitioners shall

remain present before the court below on each

and every date till one year or till disposal of the

case, whichever is earlier. If the petitioners fail to

remain present on two consecutive dates without

any reasonable explanation the privilege granted

shall be deemed to be canceled.
