Heard learned counsel for the petitioners and

learned Additional Public Prosecutor for the State, who

is armed with carbon copy of the case diary.

Petitioners are named accused in this case

with allegation of intercepting the informant and taking

away some cash and mobile and putting further demand

of huge amount. As alleged, due to prompt arrival of

the Police nothing more could happen but the petitioners

could be apprehended with the help of villagers and, as

further appears, one mobile and fire arm said to have

been recovered from the possession of the petitioners

who were produced to the Police who consequently

prepared production cum seiaure list. There is no

criminal antecedent against either of the petitioners.

In the facts and circumstances of case, both

the petitioners are directed to be enlarged on bail on

furnishing bonds of Rs.10,000/- (Rupees ten thousand)

with two sureties of the like amount each to the

satisfaction of the Subdivisional Juridical Magistrate,

Kaimur at Bhabua, in Adhaura P.S. Case no.09 of 2010,

Tr. No. 1702 of 2010, subject to the condition that the

petitioners shall remain present before the court below

on each and every date till disposal of the case. If the

petitioners fail to remain present on three consecutive

dates without any reasonable explanation, the privilege

granted shall be deemed to be cancelled.
