Heard learned counsel for the appellant, learned A.G.A. and perused the lower
court record.
It is contended by learned counsel for the appellant that the allegation against
the appellant is that he attempted to commit rape with his mami (wife of the
maternal uncle). No allegation of the rape has been made. The appellant was
on bail during the trial, he has not misused the liberty of bail.
Let the appellant Vijay convicted in S.T. No. 374 of 2009 (case crime no. 290
of 2009), Under Section 376/511 IPC, P.S. Tanda, District-Rampur be
released on bail on his furnishing a personal bond and two sureties each in the
like amount to the satisfaction of the Court concerned.
The prayer for staying the realization of fine is refused, the appellant is
directed to deposit the amount of the fine imposed by the trial Court within a
month from today from the date of his release from the jail. In default of the
payment, the appellant shall be taken into custody.
