Nobody appears on behalf of respondent no. 3.
It is the assertion of the petitioner in this Public Interest Litigation
that though respondent no. 3 Rashtriya Patrachar Sansthan is not a
recognized institution for grant of certificates equivalent to B.Ed
or B.T.C., but on the basis of the Government order dated 6.9.2000
it is being projected that it is so recognized.
Counter affidavit has been filed on behalf of respondent no. 1 in
which it has been stated as follows:-
“That the contents of paragraph no. 11 of the writ petition are
wholly misconceived and misleading hence vehemently denied. It
is submitted that the heading of the letter dated 6.9.2000
specifically states about the sending of documents relating to
‘Rastriya Patrachar Sansthan’ to the UGC, New Delhi. The fact is
that in reply to the certain quarries made by the UGC vide its
letter dated 6.9.1999 regarding Rashtriya Patrachar Sansthan,
Kanpur, the required informations were sought from the Regional
Higher Education Officer, Kanpur and the informations received
from the Regional Higher Education Officer, Kanpur were sent to
the UGC through the letter dated 6.9.2000. No where in the said
letter it has been stated that State Government has ever
recognized the ‘certificates’ issued by the aforesaid Sansthan.”
As a large number of prospective students may be swayed by the
Government order dated 6th of September 2000, we deem it
expedient that the State Government issues a public notice in
important newspapers widely circulated in the State with regard to
its aforesaid stand in the matter.
It be published within two weeks from today.
List it on 25th of January 2010.
The public notice so published shall be placed on record.
