Heard learned counsel for the petitioners.
Suit was filed by the plaintiffpetitioners seeking permanent
injunction to restrain the defendantrespondents from interfering in
their possession over the suit property and not to raise any
construction. An application for temporary injunction was also
moved. The grievance of the petitioners is that trial court refused
to grant ex parte temporary injunction and only issued notices.
Trial court after considering the averments made and the material
brought on record, did not find it a fit case to grant ex parte
temporary injunction, hence, issued notices.
There is hardly any reason or occasion for this Court to interfere in
the discretion exercised by the trial court at this stage.
In view of above, the relief prayed for in this petition is not liable to
be allowed. The writ petition, accordingly, fails and stands
dismissed.
