02. 27.04.2011 Petitioner is apprehending his arrest in a case
registered under Sections 109, 120B of the I.P.C. Section
13(I) (d) (II) read with Section 13(2) of the Prevention of
Corruption Act and Section 135 and 138 of the Electricity
Act.
The accusation is of illegal consumption of
electricity by tampering the meter by the owner and the
tenant in the shop of Imam Shopping Centre. The
accusation against this petitioner is that being Assistant
Engineer in the Electricity Board he was in league with
the consumers making illegal consumption of the
electricity.
It is submitted by learned counsel for the
petitioner that petitioner reported about the illegal
consumption and when the show cause was asked by the
vigilance, petitioner submitted his show cause. Moreover
for the theft of electricity, vigilance is not empowered to
lodge the case which is a well settled law.
Learned counsel for the vigilance submits that
officials of the Electricity Board are equally responsible
for illegal electricity consumption.
Considering the fact that the thrust of accusation

is against the consumers, let the petitioner namely Vinod
Kumar Singh, in the event of his arrest or surrender
before the Court below within a period of 12 weeks from
today, be released on anticipatory bail on furnishing bail
bond of Rs. 10,000/-(ten thousand) with two sureties of
the like amount each to the satisfaction of Special Judge,
Vigilance, 1st, Patna in connection with Special Case No.
43 of 2006 arising out of Vigilance P.S. Case No. 49 of
2006.
