The petition is dismissed as the charge already stands

framed. However, if the petitioner files a plea for the grant of exemption

from personal appearance, the learned Trial Court shall favourably

consider it. It will be open to the learned Trial Court to pass that order

with any rider qua the personal appearance of the petitioner for the

purpose of recording his statement under Section 313 Cr.P.C. or

otherwise.
