learned advocate Mr. AV Thakkar on behalf of applicant.

The
present application is filed with a prayer to condone the delay of
247 days in filing first appeal. Learned advocate Mr. HG Majmudar
appearing for respondent no. 3 the Oriental Insurance Co. Ltd.,
driver is deleted and Owner is not served. Therefore, application
is taken up for hearing.

Considering
submissions made by both learned advocates and averement made in
this application followed by affidavit, delay of 247 days is
condoned in the interest of justice as sufficient cause is shown by
applicant to the satisfaction of this Court.

Accordingly,
Rule is made absolute.

Registry
is directed to notify First appeal on 16/10/2008.
