JUDGMENT

The
petitioner by this petition has challenged the action of the
respondent Bank of holding of public auction of the property of
Flat No.B/1, 2nd Floor, Anoli Cooperative Housing Society
at Bodakdev.

When
the matter is taken up for final hearing, Mr.Rana, learned counsel
appearing for the respondent Bank states that he has received
instructions that the loan account in question is already settled
and the Bank has also issued No Objection Certificate on
25.02.2008, copy whereof is produced by him and he further states
that as the loan account is settled, there would not be any further
steps for recovery.

In
the above view of the matter, as the account is settled by the
Bank, the question of auction of the property would not arise,
which is subject matter of this petition.

Hence,
the petition is disposed of accordingly.
