Heard
learned AGP Ms.Thakkar.
The
basis of the present petition is alleged breach and noncompliance of
the order dated 19.4.2010 passed by this Court in Special Civil
Application No.11533 of 2009 whereby direction was issued to consider
the application for compassionate appointment as per the policy
prevailing then.
After
the process was issued, this Court on 7.7.2010 passed the following
order.
“Learned
AGP states that letters patent appeal has been preferred. However, it
has not been moved on account of delay or otherwise.
In
the event, any prohibitory orders are not passed, it will be for the
respondent to comply with the order which may be subject to the
outcome of the letters patent appeal.
Learned
AGP further states that some time may be granted. Hence, S.O.
to 14.07.2011.”
Today
when the matter is taken up for hearing, learned AGP places on record
orders passed by the Director General of Police as well as Police
Superintendent, Amreli whereby compassionate appointment has been
offered subject to the outcome of the Letters Patent Appeal.
In
view of the above, the cause does not survive for the present.
Hence, present proceedings are disposed of accordingly. Notice is
discharged.
