Learned
counsel, Mr.Rajesh M. Chauhan, appearing with learned counsel,
Mr.Hemant Munshaw, made a statement, on written instruction dated
20th
November 2010 of the respondent, that the respondent has already made
a resolution no.877 on 19.11.2010 to pay to the appellant full amount
of Rs.2,63,011.75 ps. within six weeks from today. Therefore, the
appeal is not pressed for any further relief with the request to
direct the respondent to abide by the statement. Accordingly, the
appeal is disposed as not pressed after recording the above statement
and with the direction that the respondent shall abide by the
statement recorded herein above. The appeal as well as Civil
Application stands disposed accordingly.
