In
pursuance of notices of this Court, Police Sub Inspector, Sutrapada
Police Station, Mr.Harish Kalasagara has produced corpus of
Arjanbhai Kanabhai Parmar before this Court, today. Though the
matter was fixed on 12th August, 2008, but since the
corpus has been traced out, the matter was preponeded and taken on
board. The applicant Masaribhai Kanabhai Parmar is also present.
We have ascertained the wish of Arjanbhai Kanabhai Parmar and he has
stated that on account of apprehension of respondent Nos.4 and 5, he
had absconded and, thereafter, was arrested by police in
C.R.No.3013/2007 and was produced before the Judicial Magistrate,
First Class, Veraval and from there, he was released on bail.
Mr.Arjanbhai Kanabhai Parmar has submitted that at present, he is
staying at Village : Nakhada, Taluka : Sutrapada along with his
family and he intends to go to Village : Nakhada. He expresses
though some apprehension on behalf of the respondent Nos.4 and 5 for
which he may file proper application before police and that
Sutrapada Police Station shall take appropriate measure in this
regard.
Mr.
Mr.Harish Kalasagara , Police Sub Inspector, Sutrapada Police
Station present before this Court through learned APP Mr.M.R.Mengdey
submits that there is no likelihood of breach of peace, as
sufficient preventive measure are taken against the respondent Nos.4
and 5.
In
view of above, this application now does not survive and is disposed
of. Mr.Harish Kalasagara, Police Sub Inspector, Sutrapada Police
Station is directed to take Mr.Arjanbhai Kanabhai Parmar under
protection to Village: Nakhada as Mr.Arjanbhai Kanabhai Parmar
intends to go to Village : Nakhada. Mr.Harish Kalasagara, Police
Sub Inspector, Sutrapada Police Station is to see that till
Mr.Arjanbhai Kanabhai Parmar reaches to Village : Nakhada, no
untoward incident occurs. Notice is discharged.
