ORAL ORDER
The
Official Liquidator to join ARCIL as party respondent. It is stated
that the Bank of India has assigned its debt to the ARCIL. The
amendment shall be carried out on or before 10th July,
2008.
NOTICE
to newly added respondent
returnable on 28th July, 2008.
In the meanwhile, the
learned Advocate Mr.Mukesh Patel appearing for respondent No.2 C.K.P
Co-op. Bank Ltd. to place on record a copy of the order passed in
Company Application No.327 of 2002.
So far as the relief
sought for in paragraph 11(b) is concerned, which reads as under:-

Hon’ble Court may be pleased to ratify the action taken by the
Official Liquidator in changing the security arrangement on the
factory premises of the company w.e.f 23.08.2006 and be further
pleased to permit the Official Liquidator to pay the bill of the
newly appointed security from the funds available with the Official
Liquidator under the head Company Paid Staff Salary Reserve Funds
A/c., which shall be reimbursed by the Official Liquidator from
realization of the amount from sale of assets of the company,??
the
learned Advocate Mr.Jani for the Official Liquidator has invited the
attention of the Court to Item No.6 in Tabular Form at Page No.61 of
the petition i.e. 17.08.2007 to April 08 i.e. 8 months and 15 days @
Rs.16,200/- and payment amount of Rs.1,37,440/- is yet to be made to
security agency.
The
Official Liquidator is permitted to make the payment as prayed for.
