No proceedings other than the appeal are pending
against the petitioner. The appeal of the petitioner is still pending
before the appellate Court. The petitioner has approached this Court
with the grievance that the appellate Court is not having power to
permit compounding of the offences. It will be appropriate for the
petitioner to first plead whatever his pleas are before the appellate
Court. The appellate Court may pass any appropriate order. This
Court can take into consideration any compromise or all such matters
if any such matter is brought in any legal proceedings before this
Court. At this stage, no case for interference is made out.
Counsel for the respondent seriously disputes the
existence of compromise. This will be an added reason for this Court
not to interfere, at this stage.
Dismissed.
