This
Court (Coram : Hon’ble Mr. Justice H.B.Antani) vide order dated
29.07.2008 dismissed Criminal Misc. Application No.8496 of 2008.

Mr
SV Raju, learned Senior Advocate appearing with Mr Abhishek Mehta,
learned advocate for the applicant placing reliance on the decision
of the Full Bench decision of this Court in the case of Babubhai
Bachubhai Bhabhor v. State of Gujarat reported in 2004(3) GLH 101 and
submitted that this matter is required to be heard by the same Bench.

In
view of the above, Registry is directed to examine the above aspect
and place the matter before Hon’ble the Chief Justice for passing
appropriate order.
