2. 13.7.2011. Heard learned counsel for petitioners and learned
counsel for the State.
Apprehending their arrest the petitioners seek bail in a
case arising out of a complaint in which cognizance has been taken
for the offence under section 498A of the Indian Penal Code.
It is submitted that petitioner no.1 is father-in-law,
petitioner no.2 is mother-in-law, petitioner no.3 is brother-in-law
(Bhainsur) and petitioner 4 is sister-in-law (Gotni). Learned counsel
for the petitioners submits that admittedly marriage of the
complainant took place on 23.4.1998 and the complainant is blessed
with three children out of wedlock with co-accused Sanjay Lal Deo.
Learned counsel for the petitioners has also brought on record an
enquiry report submitted by the police officer to the Senior
Superintendent of Police, Darbhanga which is marked as Annexure-
2 to this bail petition. The said enquiry was conducted pursuant to
some sort of allegation made by the complainant against her
husband and in-laws. The enquiry report dated 3.1.2010 goes to
suggest that the police officer opined that there was incompatibility
between husband and wife and allegation of subjecting her to cruelty
was found unfounded.
Taking into consideration the aforesaid fact as also the

fact that the case arises out of a complaint, let the petitioners,
namely, 1.Yogendra Lal Deo, 2. Mala Devi @ Malo Devi, 3.
Dharmendra Lal Deo and 4.Sangita Devi in the event of their arrest
or surrender before the court below within a period of four weeks
from the date of communication of the order be released on bail on
furnishing bail bonds of Rs.5,000/- (five thousand) with two sureties
of the like amount each to the satisfaction of Sub. Divisional
Judicial Magistrate, Darbhanga in connection with C.R. Case
No.2775 of 2010 (T.R. No.3765 of 2011).
