2 28.06.2011 Heard learned counsel for the

petitioner as well as learned counsel for

the State.

Petitioner claims for a direction to

the respondents to appoint him as Physical

Trained Teacher on the basis of his ranking

in the provisional panel as contained in

Annexure-3.

However, in the counter affidavit it

is stated that after the provisional panel

was prepared and notice was issued in the

newspaper for the candidates to appear in

the counselling for preparation of final

panel, petitioner did not appear in the

counselling pursuant to the notice issued

in the newspaper. Hence, in the final list,

name of the petitioner was not included.

This fact is not denied by the petitioner.

In the circumstance, this Court does

not find any merit in this application. The

same is dismissed.
