ORDER

Rule.

Mr. H.L. Jani, learned APP waives service of Rule.

Having
regard to the facts and circumstances of the case, the application is
taken up for hearing today.

This
is an application for deletion of condition no. [i] of the order
dated 24.12.2009 passed in Criminal Misc. Application No. 14044 of
2009 and the order dated 13.5.2010 passed by this Court in Criminal
Misc. Application No. 1709 of 2010 and/or for modification of the
conditions of the order dated 24.12.2009.

Having
heard the learned counsel for both the sides, the application is
partly allowed. Condition no. [i] of para-5 of the order dated
24.12.2009 passed by this Court in Criminal Misc. Application No.
14044 of 2009 is modified to the effect that “the applicants
shall mark their presence at the concerned police station on any day
of every first week of English Calendar month between 9.00 AM and
2.00 PM till the charge is framed” instead of “till
the trial is over”.

Save
and except the aforesaid modification, no other modification is
prayed.

The
application is partly allowed. Rule is made absolute to the aforesaid
extent. Direct service permitted.
