: Anticipatory bail application filed by petitioner Zakir
Hussain is moved by Sri. Arvind Kumar Chaudhary and opposed by Sri ,
H.K. Shikarwar, learned Additional P.P.
It is alleged that the petitioner being a Panchyat
Sevek has demanded illegal gratification from different beneficiaries of
Indira Awas Yojana.
Learned Additional P.P. submits that if petitioner
deposit Rs. 50,000/- in State Exchequer as a condition for bail then he
has no objection in grant of anticipatory bail.
Considering the aforesaid facts and circumstance, I
allow this application and direct the petitioner to surrender in the court
below by 18.03.2011 and in that event the court below is directed to
enlarge the petitioner, above named, on bail on furnishing bail bond of
Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each
to the satisfaction of Chief Judicial Magistrate, Deoghar in connection
with Mohanpur P.S. Case No. 245 of 2010 ( G.R. No. 1018 of 2010) ,
subject to the condition as laid down under section 438(2) of the
Cr.P.C. and subject to further condition that he will deposit Rs. 50,000/-
in the Civil Court, Nazarat as a condition for bail. The Nazir, Civil Court,
Deoghar is directed to deposit the said amount in the State Exchequer
under Miscellaneous Head.
