Heard Sri Vinod Sinha, learned counsel for the petitioner and
learned Standing Counsel for the respondents.

By means of the present writ petition the main relief which is
claimed by the petitioners is that the respondent Nos. 3, 4 and 5 be
directed to publish waiting list of B.T.C. candidates of Urdu
against 46 vacant seats which had yet not been filled up for the
Session of 2006 so that the applicants who had applied against the
said vacancies may know their results and get admission in time.

Factual matrix of the present case as submitted by the learned
counsel for the petitioner are that in the year 2006 a selection has
taken place for appointment on the post of Urdu Teacher for
Primary School in Shahjehanpur District and for the said purpose
an advertizement was issued in daily Newspaper “Amar Ujala”.

He submits that in response to the said advertizement the
petitioner submitted his candidature on 25.03.2006. Later on
without any rhyme or reasons the Competent Authority has not
issued the waiting list in respect to the selection in question for
appointment to the post of Assistant Teacher (Urdu) for Primary
School in District Shahjehanpur.

Learned counsel for the petitioner further submits that aggrieved
by the said action, the petitioners had submitted representations to
he Competent Authority. Moreover a letter dated 05.09.2008 was
written by the respondent No. 4 to respondent No. 2 in this regard
but no heed has been paid by the O.P. No. 2. Hence the present
writ petition has been filed by the petitioners for redressal of their
grievances.

In view of the abovesaid facts and in the interest of justice it is
provided that the petitioners are permitted to make a fresh
representation to respondent No. 2 (Director of Education (Basic),
U.P., Lucknow) within a period of two weeks from the date of
receiving the certified copy of this order annexing all the relevant
documents and materials in support of their case along with self
addressed envelope and after receiving the same respondent No. 2
shall consider and dispose of the same by way of speaking and
reasoned order in accordance with law within a further period of
six weeks thereafter and communicate the same to the petitioners.

With the above observations, the writ petition is finally disposed
of.

It is clarified that this Court has not adjudicated the claim of the
petitioner on merit.
