Madras HC grants advance bail to mentally ill man

The Madras High Court today granted anticipatory bail to a 61-year-old mentally challenged man, who allegedly murdered his wife and inflicted injury on himself last year.

Granting anticipatory bail to the man, on a petition by one of his sons Kamaraj fearing arrest of his father, Justice S Vimala said, “putting the senior citizen behind bars at a stage when both his physical and mental health is not in a good condition, would not only cause administrative problems for jail authorities, but would cause further deterioration of his health conditions”.

The Judge also recorded the assurance given by the sons to the court that they would take proper care of their father and they would ensure that public is not put to any difficulty on account of their father’s conduct.

The support and solace that could be provided by the family members who are well accustomed to the daily routines of the man would be certainly superior to the institutional care, the judge observed.

On September 9, 2015 when the sons of the man returned from their agricultural field, they saw their mother lying dead and father struggling with injuries on his stomach.

The man told his sons that he had beaten his wife to death with wooden logs and he himself inflicted injuries on his stomach.

The sons reported the incident to Sathyamangalam police.

The man was was admitted to Coimbatore Medical college Hospital and its medical report said he has been suffering from chronic psychiatric problem.

While granting anticipatory bail, the judge directed the sons to make the petitioner available for medical examination and for investigation as and when sought by the police.
