New Delhi, A Delhi court has acquitted a man of charges of kidnapping and raping a minor girl after she deposed that neither the accused nor any other person had committed sexual assault upon her.

Additional Sessions Judge let off the North Delhi resident after noting that the prosecution has miserably failed to prove the charges against the accused.

“In view of the material on record, it is evident that everything has happened with will of prosecutrix. In these circumstances, the factum of kidnapping of prosecutrix does not stands proved…

“Moreover, the prosecutrix categorically deposed that the accused did not establish physical relations with her and denied that neither the accused nor any other person committed sexual assault upon her…Thus, in the light of the evidence recorded the allegations against the accused are not proved,” the court said.

According to the prosecution, the 15-year-old girl went missing on April 5, 2013 after which her mother lodged a missing complaint alleging that she has been kidnapped by some one.

On April 9, 2013, the girl returned back and was medically examined. She told the police that the accused enticed and raped her. The accused was arrested on the basis of her statement after which charge sheet was filed.

However, later the girl deposed before the court that she voluntarily left her home as she was unhappy with the marriage being fixed by her parents and boarded bus to Haridwar.
