A Delhi court has sentenced a man to 10 years in jail and imposed a fine of Rs one lakh on him for possessing 500 grams heroin after considering that he was carrying commercial quantity of the banned drug and its impact on the youth.

Special Judge Narinder Kumar held Uttar Pradesh native Jane Alam guilty of offences under sections of the Narcotic Drugs and Psychotropic Substances Act (NDPS).

“Keeping in view the quantity of heroin recovered from his possession and its impact on the youth in society and also the minimum sentence provided by the legislature, convict Jane Alam is hereby sentenced to undergo rigorous imprisonment for a period of 10 years and to pay a fine of Rs 1 lakh…,” the court said.

The court found that the statements of the prosecution witnesses were consistent and ruled out the possibility of tampering with the evidence.

“Statements of witnesses are consistent on all material aspects and prosecution has ruled out possibility of tampering with case property including the sample parcels… court finds that charge for the offence under NDPS Act stands established against the accused, as the accused kept in his possession 500 grams of heroin,” the court held.

According to the prosecution, the police officials got a tip off that on May 16, 2014, Alam, who was carrying drugs, would visit a spot near Guru Govind Singh University bus stand in Central Delhi. He was caught by the cops carrying 500 grams heroin, it said.

The man, however, had claimed that he was wrongly held while travelling in an auto in northeast Delhi and pleaded not guilty, but chose not to lead any defence.
