The bench comprising Justices A.M. Kapadia and B.N. Mehta directed Girish Das, in a suo motu contempt proceeding, to be present in court as he failed to do so during a hearing.
Das said that he has filed an affidavit before the division bench tendering an apology but the bench had orally asked him to tender apology before the judge before whom he made the objectionable remarks.
Das is facing contempt charges over his comments to Justice K.S. Jhaveri.
The matter is slated to come up Jan 24.
