CJI comes under RTI: Delhi HC

Delhi High Court upheld the Chief Information Commissioner’s order that the RTI Act covers the Chief Justice of India’s office because he is a public authority.

For practical purposes, the judgment throws open the Chief Justice of India to public scrutiny. It also means that a person can move an RTI to seek information about the CJI, including about his assets.

Justice S Ravindra Bhat ordered that a person could seek information about declaration of assets by SC judges.‘The dignity of the judges add value to democracy. Judges are under public attack and revealing of assets and other information may increase the reputation of the judges,’ Justice Bhat said. The judge also noted that the office of CJI is a public authority and it is well within the purview of the RTI Act.

‘Chief Public Information Officer of the Supreme Court shall release the information about the declaration of the assets to the petitioner within four weeks time,’ he said
