This case has been listed before this court on the basis of Letter No.
935/1/Auraiya dated 9.11.2009 sent by Sri A.K. Agarwal, District & Sessions
Judge, Auraiya in which it has been prayed that the record of S.T. No. 168 of
2009 State Vs. Hosiyar Singh may also be transferred to the Sessions Court,
Lucknow where the S.T. No. 15 of 2009 in respect of other co-accused has
already been transferred by the High Court vide order dated 11.5.2009.
From the perusal of the record it appears that the co-accused Hosiyar Singh
whose sessions trial No. 168 of 2009 is pending before Sessions Judge,
Auraiya is also one of the accused of S.T. NO. 15 of 2009 which has been
transferred to Lucknow from Sessions Court Auraiya vide order dated
11.5.2009. IN such circumstances, the S.T. No. 168 of 2009 may also be
transferred to the same court where S.T. No. 15 of 2009 and 37 of 2009 have
been transferred. Therefore, it is directed that the record of the Sessions Trial
No. 168 of 2009 State Vs. Hosiyar Singh pending in the court of learned
Sessios Juege, Auraiya shall be transferred to the Sessions Court, Lucknow.
The trial of accused Hosiyar Singh shall also be done by the same Judge
where the trial of the other co-accused is pending.
With the above direction, this application is allowed.
Let a copy of this order be communicated to learned Sessions Judge, Auraiya
and learned Sessions Judge, Lucknow for the compliance within a week.
