ORAL ORDER

This
application has been preferred for condonation of delay of 69 days in
preferring appeal against the order dated 15.10.2010 passed by the
learned Single Judge in Special Civil Application No.3605 of 1994.
The said writ petition was filed challenging the validity of the
order dated 22.10.1990 passed by the Gujarat Revenue Tribunal which
was affirmed by this Court in another case being Special Civil
Application No.4727 of 1991 by judgment dated 28.12.1993.

Heard
the learned counsel for the applicant and Ms Krina Calla, learned AGP
who appeared on behalf of the respondent-State of Gujarat and Revenue
Officer – Deputy Mamlatdar, Revenue at Dholka, District
Ahmedabad and waived notice.

On
hearing the parties and being satisfied with the ground, the delay of
69 days in preferring the appeal is condoned, subject to objection,
if any, as may be raised by respondent Nos.3 to 10 to whom we have
not issued notice in view of the order that we intend to pass in the
main appeal.

The
civil application stands disposed of.
