2 1.9.2010 The petitioner prays for a direction to the respondent

authorities to provide security to the petitioner as per

recommendation made by the District Magistrate, Arwal vide his

letter no.332 dated 20.2.2004, contained in Annexure-2.

The petitioner made a complaint to various authorities

including the Chief Secretary alleging therein threat to his life

and property by the miscreants. In pursuance of the aforesaid

complaint, contained in Annexure-1, the Chief Secretary

directed the District Magistrate, Arwal to inquire into the matter

who in turn recommended to the Superintendent of Police,

Arwal vide his letter dated 20.2.2004 to provide security to the

petitioner.

A counter affidavit has been filed on behalf of the

State. From perusal of Annexure-A to the counter affidavit, it

appears that some of the persons namely Smt. Geeta Mandal and

Mr.Anuj Kumar Singh, Member, Bihar Legislative Assembly

were directed to be provided security, whereas other persons

have been denied on the ground of paucity of security guard.

Learned State counsel submits that on the F.I.R.

lodged by the petitioner, the police has submitted charge sheet

and the accused have been put behind the bar. He further

submits that during the last five years no other serious threat to

the life and property of the petitioner has come to light.

In view of the averments made in the counter affidavit,

this court is not inclined to pass any positive order. Suffice it to

say that in case the petitioner apprehends threat to his life and

property, it would be open to him to make a representation

before the authorities concerned for grant him security who

would consider the same on its own merits.

With the aforesaid observations and directions, this

writ petition stands disposed of.
