                           JUDGMENT

Exts.P2 and P3 revenue recovery notices issued at the

instance of the respondent Bank, for realising the dues of

the petitioner are under challenge. Admittedly two loans

have been availed of and default has been committed. In

this writ petition, though several contentions have been

urged, when the matter was taken up for admission, learned

counsel for the petitioner confined his prayer for an

instalment facility to discharge the dues to the Bank.

2. In view of the limited nature of the relief that is

sought for, I heard the counsel for the respondent bank

also in this matter. Having regard to the submissions I feel

that, an opportunity should be extended to him to avoid

coercive action as proposed in Exts.P2 and P3.

3. Therefore the writ petition is disposed of directing

that the petitioner shall pay the amount due to the Bank in

six equal monthly instalments, the first of which shall be

paid on or before 29.8.2008. Subsequent instalments shall

be paid on or before 29th of every succeeding month. It is

clarified that in case the petitioner commits any default in

paying any of the instalments, it will be open to the

respondent to continue the proceedings without further

notice.
