This
appeal is directed against order dated 6th
October 2008 passed by the learned Single Judge in Special Civil
Application No.12199 of 2008 whereby the learned Single Judge
rejected the petition filed by the petitioner.
Heard
the learned counsel for the appellant. The learned Single Judge has
noticed that the petition has been filed after 11 years from the date
of retirement for exercising the option. Period of 11 years
is a very long time. That being the position, the appellant was not
alive to his rights and if he chooses to come this Court after 11
years and if no indulgence is shown in his favour by the learned
Single Judge, no illegality can be said to have been committed by the
learned Single Judge.
Hence,
the appeal has no force. The same is dismissed in limine.
