Supplementary affidavit filed today is taken on record.
Applicant is an accused for an offence of murder along with conspiracy under
section 120B I.P.C. vide case crime no. 2041 of 2009. Investigation resulted
in charge sheeting the applicant. He was summoned and now the case is
pending before the Trial court as S.T. no. 804 of 2010 State versus Arun.
Applicant has approached this court for quashing the charge sheet. The
offence is disclosed against the applicant during investigation. No material
collected during investigation has been appended along with this criminal
misc. application. In absence of those material, it cannot be considered either
as to whether applicant has committed any offence or not ?
For the aforesaid reasons, this application is dismissed.
