                  W.P.(C) NO. 35889 OF 2010
                 =====================

Dated this the 22nd day of December, 2010

                         J U D G M E N T

Petitioner passed her secondary school examination and

Plus One examination. However, due to various diseases that she

is suffering from and on account of the continuous treatment, she

could not complete her plus two course by appearing in the

examination. She is also unable to continue attending classes,

and therefore, she has approached this Court seeking a direction

to respondents to allow her to register herself as a private

student.

2. Learned Government Pleader, who has obtained

instructions in the matter submits that since the petitioner did not

have sufficient attendance, she cannot appear in the regular

stream. It is stated that, in such circumstances, the only option

available to the petitioner is to get herself registered as a private

candidate, and for that purpose, petitioner will have to make an

application before the Director of Higher Secondary Education.

3. Now that the Government Pleader has made the

aforesaid submission, the only option available to the petitioner is

WPC No. 35889/10
:2 :

to make an application before the Director of Higher Secondary

Education. It is directed that if the petitioner makes an

application to the Director of Higher Secondary Education as

mentioned above, the Director shall consider the application and

pass appropriate orders in the matter, which shall be done at any

rate within 4 weeks of receipt of the application. Needless to say

that it will be the responsibility of the petitioner to comply with

the procedural formalities which are to be completed in that

behalf.

Writ petition is disposed of as above.
