This order governs the disposal of bail petition filed under section 439 of Cr.P.C. by Mr. Vikas Ganan Advocate on behalf of the applicants pertaining to FIR No.197/2009 of Police Station Kekri, District Ajmer in the offences under sections 5(1), 8(2) and 9(2) of Rajasthan Bovine Animal (Prohibition of Slaughter and Migration or Export) Act, 1995.

2. Heard the learned counsel for the petitioners as also the learned Public Prosecutor for the State and perused the relevant material available on record.

3. Learned counsel for the petitioners has canvassed that the petitioners are the drivers and conductor of the vehicle. The cows did not belong to them. They have been falsely implicated and are in no way connected with the commission of the alleged offences of the instant case. Hence, they may be granted indulgence of bail.

4. Learned Public Prosecutor has opposed the bail petition.

5. Having considered the submissions made at the Bar and perused the relevant material available on record, I, without expressing any opinion on the merits of the case, do feel inclined to grant bail to the petitioners and the bail petition is ordered to be allowed.

6. It is, therefore, ordered that the accused petitioners namely Bahadur Singh S/o. Badri lal; and Mahendra Singh S/o. Mohar Singh in FIR No.197/2009 of Police Station Kekri, District Ajmer, shall be released on bail on furnishing a personal bond each in the sum of Rs.1,00,000/- together with three local surety bonds each in the sum of Rs. 15,000/-, duly verified from the concerned Tehsildar, to the satisfaction of the learned trial court with the stipulation that they shall appear before that court on all dates of hearing and as and when called upon to do so till the trial is concluded.
