Baijnath Chouksey & Ano. vs. State of M.P & Ors.
W.P. No.10892/2010
16.08.2010
Heard Shri A. P. Singh, learned counsel for the petitioner, on
the question of admission.
The petitioner has filed this petition alleging inaction on the
part of the respondent authorities in conducting an enquiry against
respondent no.4 for the negligence in the treatment of the husband
of petitioner no.2 and in denial of documents to the petitioners
inspite of repeatedly asking for the same.
As is evident from the documents, filed by the petitioners,
they have already approached the Additional District Magistrate
and the Sub Divisional Magistrate with their grievance for taking
proper steps in the matter and that the Additional District Magistrate
has called for the report from the police authorities and the Sub
Divisional Magistrate has asked the Chief Medical and Health
Officer to submit a report. It is further evident that the police
authorities and the Chief Medical and Health Officer have not
conducted any enquiry nor submitted their report as directed by the
Additional District Magistrate and the Sub Divisional Magistrate
respectively.
In the circumstances the petition, filed by the petitioner, is
disposed of with a direction to respondent no.2 Collector,
Hoshangabad and the Superintendent of Police,
Hoshangabad to look into the matter and deal with the same
expeditiously in accordance with law.
With the aforesaid direction the petition, filed by the
petitioner, stands disposed of.
C.C as per rules.
