As per allegations of the prosecution, 260 gms smake was
found from the possession of the petitioner. Learned counsel for the
petitioner has submitted that as per chemical report, the percentage of
Diacetyl Moirphine was 28% of the total weight, which comes to 72.9 gms.
He has contended that quantity is non commercial. To support his
contention, he has relied upon authority Rakesh Kumar v. State of
Haryana 2006(1) R. C. R. ( Criminal ) 9.

So, in view of the above authority, bail to the satisfaction of
trial Court.
