In
view of the fact that Special Civil Application No.11309 of 2002 is
pending, this Court is not inclined to recall or review the order
dated 28.06.2005 passed in Letters Patent Appeal No.2045 of 2004.
However, the Letters Patent Appeal having preferred against the
interim order passed by the learned Single Judge, the parties cannot
take advantage of the said order in the writ petition which may be
decided on merits.

Let
the Special Civil Application be listed before the learned Single
Judge on 22nd March 2010.
