Heard learned counsel for the petitioner and Shri Ashok Kumar Singh,
learned counsel for the respondents.
The petitioner applied for recruitment as a Sub-Inspector in the Central
Police Organization through an examination of 2009. The physical
efficiency test was to be held on 29.12.2009 and 30.12.2009 for which
the petitioner’s name was put on the website.
Learned counsel for the petitioner contends that the said letter was
received by the petitioner on 08.01.2010 when he down loaded the
same from the Internet.
The physical efficiency test as well as the medical examination test is
still continuing and is stated to continue till 15.01.2010.
Learned counsel for the petitioner contends that the petitioner may be
permitted to appear for the physical efficiency test as well as for the
medical examination test before the respondent no. 2.
In the peculiar facts of the present case as disclosed the writ petition is
disposed of with a direction to the respondent no. 2 to permit the
petitioner to appear in the physical efficiency test and in the medical
examination test in respect to the candidature of the petitioner as
indicated on the website. This order shall not be a precedent for any
other claim.
A certified copy of this order may be given to the learned counsel for the
petitioner today on payment of usual charges for necessary service on
the said respondents.
