These aforesaid two petitions filed under section 482 of the

Code of Criminal Procedure arise out of one and the same occurrence which

had taken place on 16.1.2009 as a result of which FIR bearing No. 9 dated

22.1.2009, under sections 323, 324, 427, 448, 506, 148, 149 IPC (Annexure

P/1) was registered at Police Station Mukerian, District Hoshiarpur, at the

instance of Janak Singh complainant-injured in this case. Thereafter during

investigation, a cross-case was also registered under sections 323, 324, 34

IPC, at the instance of Mohinder Singh petitioner in Criminal Misc.-M No.

9444 of 2009. Now in both the cases, investigation is still going on. In the

meantime, parties arrived at compromise vide Annexure P/3. Today, Janak
Criminal Misc.-M No. 9444 of 2009 (O&M) -2-

Singh and Mohinder Singh, on whose instance these two cases were

registered against each other are present in the Court. On query put to

them, they have fairly stated that the matter has been settled amicably and as

such they have no objection if the aforesaid FIR and also the cross case, are

quashed.

In the given facts and circumstances, this Court feels that no

useful purpose would be served if the proceedings in the case in hand are

allowed to continue. It would be in the interest of peace and harmony

between the parties to close the chapter of this case.

In the result, both the petitions succeed and consequently, FIR

bearing No. 9 dated 22.1.2009, under sections 323, 324, 427, 448, 506, 148,

149 IPC (Annexure P/1) registered at Police Station Mukerian, District

Hoshiarpur and cross-case registered under sections 323, 324, 34 IPC in

the aforesaid FIR and all subsequent proceedings arising therefrom, are

hereby ordered to be quashed, qua the petitioners.
