Pursuant to the orders dated 3.8.2009 the petitioner has

since joined the investigation to the satisfaction of the Investigating

officer which fact has not been controverted by the learned counsel

appearing for the State on instructions from ASI Jarnail singh.

Having regard to the aforesaid fact that the petitioner has

since joined the investigation to the satisfaction of the Investigating

officer, the present petition is allowed and the interim directions dated

3.8.2009 are hereby made absolute till the filing of the challan subject

to the condition that the petitioner continues to comply with the

provisions of Section 438(2) Cr.P.C.
